Indemnity
By participating in the Auto&General Cross Triathlon hosted by Steyn City on 15 February 2025 (the “Event”), I acknowledge, understand and accept the terms and conditions stated herein (“Indemnity”).
Terms & Conditions
1. RULES AND REGULATIONS
1.1 I undertake to-
1.1.1 adhere to the rules and regulations, terms and conditions, safety protocols and the like; and
1.1.2 obey all decisions, rules, warnings and the like, as communicated to me by the organising body (including, but not limited to, Auto & General Insurance Company (RF) Limited (registration number:1973/016880/06), Steyn City Properties Proprietary Limited (registration number: 1997/018709/07), and their related or inter-related entities), organiser or official, marshal, assistant, the sponsors, local authority or land owners and their employees or agents and the like (the “Organisers”) to participate in the Event, whether provided to me prior to the Event, at the Event or after the Event.
2. SAFETY AND SECURITY
2.1 I acknowledge, understand and accept that the Event involves inherently dangerous physical activity that may result in physical injury to my person and/or death, or damage to my property, whether directly or indirectly, and whether caused by, without limitation, –
2.2.1 my own actions or inactions or the actions or inactions of others (including other participants, staff or spectators and the like); and/or
2.2.2 the wild animals, insects and plants that may appear in the Event course; and/or
2.2.3 the water through which part of the Event course runs that has not been tested for chemicals, disease or contamination and the like, (collectively, the “Injuries”).
2.4 I agree not to consume alcohol, medication or other substances prior to the Event that will inhibit my mental or physical ability to safely and effectively participate in the Event (“Consumption”). I further agree to subject myself to any drug tests and penalties as may be determined by the Organisers.
2.5 I consent to medical care and transportation in order to obtain treatment in the event of injury to me, as the Organisers, volunteers and/or medical professionals may deem appropriate (“Medical Care”).
2.6 I acknowledge, understand and accept there will be security guards in and around the race village and parking area of the Event but that the safety and security of my personal possessions remains my sole responsibility.
3. LIABILITY AND INDEMNITY
3.1 I acknowledge, understand and accept that the Organisers are not and shall not be liable for any loss or damage, whether direct or indirect, arising by way of Injuries, Consumption or otherwise, which I may suffer by participating in the Event, and I hereby indemnify and hold the Organisers harmless against all losses or damages.
3.2 In the instance where I receive Medical Care, I acknowledge, understand and accept that the persons providing me with Medical Care are not liable for any loss or damage, whether direct or indirect, which I may suffer as a result of receiving Medical Care, and I hereby indemnify and hold the persons providing me with Medical Care harmless against any loss or damage that I may suffer in relation to said Medical Care provided to me.
3.3 I acknowledge, understand and accept that the Organisers are not and shall not be liable for the safety and security of any of my personal possessions, and I indemnify and hold the Organisers harmless against any and all loss or damage, whether direct or indirect, that I may suffer in relation to the safety and security of my personal possessions being compromised.
3.4 I acknowledge, understand and accept that the Organisers are not and shall not be liable for any loss or damage, whether direct or indirect, that I may suffer as a result of third-party claims against me caused in whole or in part by my own negligent or intentional acts and/or omissions, and I indemnify and hold the Organisers harmless against said third-party claims.
4. PERSONAL DATA AND INTELLECTUAL PROPERTY
4.1 I consent to receive periodical email and sms notifications from the Organisers communicating necessary information and arrangements about the Event.
4.2 I consent to receive marketing communication on available products and services from the Organisers. I acknowledge, understand and accept that I may opt out of receiving said marketing communication by selecting the unsubscribe button contained in the marketing communication.
4.3 I consent to the use of my image in photographs, motion pictures or recordings taken at the Event (“Recordings”) for use in Event advertising, marketing or promotion, without limitation. I acknowledge, understand and accept that the Organisers are the sole holders of any and all intellectual property rights associated with the Recordings and that I have no interest in or right or entitlement to the intellectual property associated with the Recordings. I further acknowledge, understand and accept that I am not entitled to any compensation, profit, gain or other benefit deriving from the Organisers use of the Recordings as stated in this paragraph 4.3.
5. CANCELLATION AND REFUNDS
5.1 I agree that all registration fee payments are final and non-refundable.
5.2 I agree that the Organisers reserves the right to cancel the Event in the event of extreme weather (including, but not limited to, heat, tornadoes, earthquakes, fires, storms, lightning and floods), accidents, acts of war or terrorism, military conflicts or riots, pandemic or endemic outbreaks or for any reason that, in the Organisers’ discretion, will protect the safety and security of Event participants and spectators. In the event of such cancellation, I am not entitled to any registration fee refunds.
5.3 The Organisers may dismiss me from the Event, without refund, should my behaviour endanger the safety of or negatively affect the Event, any other person, facility or property as may be determined by the Organisers.
6. WARRANTIES AND UNDERTAKINGS
6.1 I represent and warrant to the Organisers that I have full legal authority to complete this Event registration on behalf of myself and/or any person I am registering (“Registrant(s)”).
6.2 I represent and warrant to the Organisers that I have full authority to make use of the credit or debit card to which registration fees will be charged in respect of the Registrants.
6.3 In the instance where the Registrant is a minor, I represent and warrant that I am the parent or legal guardian of that minor and have the legal authority to accept the terms and conditions of this Indemnity on behalf of said minor.
6.4 I understand and agree that use of online registration is at my own risk, on an as is and as available basis and that the Organisers make no warranty that its site or services will be uninterrupted, secure or error free. I further understand and agree that any material and/or data downloaded or otherwise obtained using online registration, is at my own discretion and risk.
6.5 I represent and warrant that I am participating in the Event voluntarily.
6.6. I represent and warrant that-
6.6.1 I am physically fit and able to participate in all activities of the Event;
6.6.2 I have no medical condition that would make participation in the Event more hazardous to myself or other participants; and
6.6.3 I will not be under Consumption at the time of the Event.
6.6 I understand and agree that the terms and conditions of this Indemnity shall apply equally to all Registrants, and I undertake to make the Registrants aware of the terms and conditions of this Indemnity.
